Welcome to www.TurnersChurch.com. The www.TurnersChurch.com website (the "Site") is comprised of various web pages operated by TURNERSCHURCH ("Church"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. If you do not agree to these Terms, you may not access or use the Site. These Terms expressly supersede prior agreements or arrangements with you. Church may immediately terminate these Terms or any services with respect to you, or generally cease offering or deny access to the Site or any portion thereof, at any time for any reason.

www.TurnersChurch.com is a Social Networking website.

Our Mission is to provide a safe space for users to connect with other like-minded individuals, to promote unity and rebuild communities.

 

  1. Privacy

Your use of the Site is subject to the Church's Privacy Policy. Please review our Privacy Policy located at http://turnerschurch.com/help/privacy, which also governs the Site and informs users of our data collection practices and use of personal information in connection with the Site.

 

III.    Electronic Communications

Visiting the Site or sending emails to the Church constitutes electronic communications. Through your use of the Site you hereby consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

 

  1. Your Account

 If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Church is not responsible for third party access to your account that results from theft or misappropriation of your account. Church, its officers, directors, employees, agents and third parties reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

 

  1. Children Under Thirteen

The Church does not knowingly collect, either online or offline, personal information from persons under the age of thirteen (13). If you are under eighteen (18) years of age, you may use the Site only with permission of a parent or guardian.

The Site may contain links to other websites or advertisements ("Linked Sites"). The Linked Sites are not under the control of the Church and the Church is not responsible for the contents or accuracy of materials on any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The Church hereby does not endorse any product or make any representation regarding the content or accuracy of any materials contained in or linked to, any Linked Sites. The Church is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the Church of the site or any association with its operators. If you decide to access any Linked Sites, you do so at your own risk. Your use of any Linked Sites is subject to the terms of use and privacy policies for such Linked Sites. Certain services made available via the Site are delivered by third party sites and organizations. By using any product, service or functionality originating from the Site domain, you hereby acknowledge and consent that the Church may share such information and data with any third party with whom the Church has a contractual relationship to provide the requested product, service or functionality on behalf of the Site’s users and customers.

 

VII. No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms of use. As a condition of your use of the Site, you warrant to the Church that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

All content included as part of the Site, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site (collectively the “Content”), is the property of the Church or its suppliers and protected by copyright under United States law and other laws that protect intellectual property and proprietary rights, and title to such Content shall not pass to you or any other user of the Site. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such Content and will not make any changes thereto.

Unauthorized use of the Content may violate copyright, trademark, and other laws. None of the Content may be reverse-engineered, disassembled, decompiled, reproduced, transcribed, stored in a retrieval system, translated into any language or computer language, re-transmitted or resold in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), resold or redistributed without the prior written consent of the Church. Your use of the Site does not entitle you to make any unauthorized use of any protected Ccontent, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use Content solely for your personal non-commercial use, and will make no other use of the Content without the express written permission of the Church and the copyright owner. You agree that you do not acquire any ownership rights in any protected Content. We do not grant you any licenses, express or implied, to the intellectual property of the Church or our licensors except as expressly authorized by these Terms.

Content is subject to change without notice at the editorial discretion of the Church. If you violate any of these Terms, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

We respect the intellectual property of others, and we ask you to do the same. It is our policy not to permit Content known by us to be infringing to remain part of the Site. If you believe that any Content provided by the Site constitutes copyright infringement, please notify us immediately of the infringing Content and provide the following information:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  • A description of the copyrighted work that you claim has been infringed;
  • A description of where the material that you claim is infringing is located on the Website;
  • Your address, telephone number, and email address;

  • A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Your notice of claim of copyright infringement can also be sent by directing an email or letter to our contact information listed below. Upon our receipt of a proper notice of claimed infringement, we will respond expeditiously to remove, or disable access to the Content claimed to be infringing and will follow the procedures specified in the Digital Millennium Copyright Act ("DMCA") to resolve the claim between the notifying party and the alleged infringer who provided the Content at issue.

 

VIII. Use of Communication Services

The Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

Through your use of the Site, you agree that when using a Communication Service, you will not:

  1. defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
  2. publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;
  3. upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents;
  4. upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer;
  5. advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages;
  6. conduct or forward surveys, contests, pyramid schemes or chain letters; download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner;
  7. falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
  8. restrict or inhibit any other user from using and enjoying the Communication Services;
  9. violate any code of conduct or other guidelines which may be applicable for any particular Communication Service;
  10. harvest or otherwise collect information about others, including e-mail addresses, without their consent; and
  11. violate any applicable laws or regulations

Any violation of (a) through (k) above shall constitute a material breach of these Terms, subject to immediate termination of your access to any Communication Service as determined by the Church in its sole and absolute discretion.

The Church has no obligation to and does not monitor or screen the Communication Service in advance or real times. However, the Church reserves the right to review materials posted to a Communication Service and to remove any materials in its sole and absolute discretion. The Church reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

The Church reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in the Church's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. The Church does not represent or guarantee the truthfulness, accuracy, or reliability of any of the material posted by users or endorse any opinions expressed by such users. The Church does not control or endorse the content, messages or information found in any Communication Service and, therefore, the Church specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. You are solely responsible for your own actions, communications and consequences of your use of any Communication Service. Managers and hosts are not authorized The Church spokespersons, and their views do not necessarily reflect those of the Church.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

 

  1. Materials Provided to the Site or Posted on Any Church Web Page

The Church does not claim ownership of the materials you provide to www.TurnersChurch.comthe Site (including feedback and suggestions) or post, upload, input or submit to any Church Site or our associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting the Church, our affiliated companies and necessary sublicensees permission to use your Submissions in connection with the operation of their internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submissions; and to publish your name in connection with your Submissions.

No compensation will be paid with respect to the use of your Submissions, as provided herein. The Church is under no obligation to post or use any Submissions you may provide and may remove any Submissions at any time in the Church's sole and absolute discretion.

By posting, uploading, inputting, providing or submitting your Submissions you warrant and represent that you own or otherwise control all of the rights to your Submissions as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

 

  1. Third Party Accounts

You will connect your Church account with such third party websites or accounts. By connecting your Church account to your third party website or account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

 

  1. International Users

The Service is controlled, operated and administered by the Church from our offices within the USA. If you access the Service from a location outside the USA, you are solely responsible for compliance with all laws or your jurisdiction. You agree that you will not use the Church Content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

 

XII. Indemnification

You agree to indemnify, defend and hold harmless the Church, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. The Church reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with the Church in asserting any available defenses.

 

XIII. Arbitration Agreement

By agreeing to the Terms, you agree that you are required to resolve any claim that you may have against the Church on an individual basis in arbitration, as set forth in this Arbitration Agreement. This will preclude you from bringing any class, collective, or representative action against the Church, and also preclude you from participating in or recovering relief under any current or future class, collective, consolidated, or representative action brought against the Church by someone else.

  • Binding Arbitration Between You and Church. You and Church agree that any dispute, claim or controversy arising out of or relating to (i) these Terms or the existence, breach, termination, enforcement, interpretation or validity thereof, or (ii) your access to or use of the Sit at any time, whether before or after the date you agreed to the Terms, will be settled by binding arbitration between you and Church, and not in a court of law. You acknowledge and agree that you and Church are each waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding. Unless both you and Church otherwise agree in writing, any arbitration will be conducted only on an individual basis and not in a class, collective, consolidated, or representative proceeding. However, you and Church each retain the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.

 

  • Rules and Governing Law. The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with the AAA's Consumer Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the "AAA Rules") then in effect, except as modified by this Arbitration Agreement. The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879. The parties agree that the arbitrator ("Arbitrator"), and not any federal, state, or local court or agency, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability or formation of this Arbitration Agreement, including any claim that all or any part of this Arbitration Agreement is void or voidable. The Arbitrator shall also be responsible for determining all threshold arbitrability issues, including issues relating to whether the Terms are unconscionable or illusory and any defense to arbitration, including waiver, delay, laches, or estoppel.

 

Notwithstanding any choice of law or other provision in the Terms, the you and Church agree and acknowledge that this Arbitration Agreement evidences a transaction involving interstate commerce and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (“FAA”), will govern its interpretation and enforcement and proceedings pursuant thereto. It is the intent of the parties that the FAA and AAA Rules shall preempt all state laws to the fullest extent permitted by law. If the FAA and AAA Rules are found to not apply to any issue that arises under this Arbitration Agreement or the enforcement thereof, then that issue shall be resolved under the laws of the state of North Carolina.

 

  • A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a form Demand for Arbitration - Consumer Arbitration Rules at www.adr.org or by calling the AAA at 1-800-778-7879). The Arbitrator will be either (1) a retired judge or (2) an attorney specifically licensed to practice law in the state of North Carolina and will be selected by the parties from the AAA's roster of consumer dispute arbitrators. If the parties are unable to agree upon an Arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the Arbitrator in accordance with the AAA Rules.

 

  • Location and Procedure. The arbitration will be conducted in Raleigh, North Carolina. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of documents you and Church submit to the Arbitrator, unless you request a hearing or the Arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the Arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

 

  • Arbitrator’s Decision. The Arbitrator will render an award within the time frame specified in the AAA Rules. Judgment on the arbitration award may be entered in any court having competent jurisdiction to do so. The Arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant's individual claim. An Arbitrator’s decision shall be final and binding on all parties. An Arbitrator’s decision and judgment thereon shall have no precedential or collateral estoppel effect. If you prevail in arbitration you will be entitled to an award of attorneys' fees and expenses, to the extent provided under applicable law. Church will not seek, and hereby waives all rights Church may have under applicable law to recover, attorneys' fees and expenses if Church prevails in arbitration.

 

  • It is your responsibility to pay AAA filing fees, and any administrative and arbitrator fees will be allocated as set forth in the AAA Rules.

 

  • Severability and Survival. If any portion of this Arbitration Agreement is found to be unenforceable or unlawful for any reason, (1) the unenforceable or unlawful provision shall be severed from these Terms; (2) severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of the Arbitration Agreement or the parties’ ability to compel arbitration of any remaining claims on an individual basis pursuant to the Arbitration Agreement; and (3) to the extent that any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration.

 

XIV. Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and the Church agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

 

  1. Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN.  THE CHURCH AND ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. YOU ACKNOWLEDGE THAT IN CONNECTION WITH THE SITE, INFORMATION WILL BE TRANSMITTED OVER LOCAL EXCHANGE, INTER-EXCHANGE AND INTERNET BACKBONE CARRIER LINES AND THROUGH ROUTERS, SWITCHES AND OTHER DEVICES OWNED, MAINTAINED AND SERVICED BY THIRD-PARTY LOCAL EXCHANGE AND LONG DISTANCE CARRIERS, UTILITIES, INTERENT SERVICE PROVIDERS AND OTHERS, ALL OF WHICH ARE BEYOND THE CONTROL AND JURISDICTION OF THE CHURCH AND THEIR SUPPLIERS. ACCORDINGLY, THE CHURCH ASSUMES NO LIABLITY FOR OR RELTATING TO THE DELAY, FAILURE, INTERRUPTION OR CORRUPTION OF ANY DATA OR OTHER INFORMATION TRANSMITTED INC ONNECTION WITH USE OF THE SITE.

THE CHURCH AND ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. THE CHRUCH AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE CHURCH AND ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF THE CHURCH OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

 

XVI. Termination/Access Restriction

The Church reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of North Carolina and you hereby consent to the exclusive jurisdiction and venue of courts in North Carolina in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Church as a result of these Terms or use of the Site. The Church's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of

the Church's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by the Church with respect to such use. If any part of this the Terms are is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, these Terms constitutes the entire agreement between the user you and the Church with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user you and the Church with respect to the Site. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that these Terms and all related documents be written in the English language.

 

XVII. Drawings and Contests

From time to time the Church may have a drawing or contest, in which case the following rules shall apply, unless the drawing or contest has separate terms and conditions. No purchase is required to win. You do not have to be present to win. Winners will be notified by email, text, or phone call in that order based on the information on the drawing card or web signup page, restrictions apply. The Church employee’s or agents are ineligible to win. You must be eighteen (18) years old to win. Only one entry is allowed per person. Only one prize is awarded per person. The winner is responsible for all taxes, fees, surcharges, if any, that result from winning. The prize is supported and warrantied by manufacturer or producer, not the Church. Prizes won are not returnable for cash or credit. Prizes are not transferable to another party other than the winner. If the winner does not, or can not accept the prize, then to prize is canceled. Drawing or contest may be canceled without notice. Contact information on the drawing card or web signup page will be used in compliance with the Church Privacy Policy.

THE TERMS OF DRAWINGS AND CONTESTS PROVIDED IN THIS SECTION ARE VOID WHERE PROHIBITED AND/OR WHERE THE DRAWING OR CONTEST CHANGES THE LEGAL STATUS OF THE CHURCH IN THE JURISDICTION OF THE DRAWING OR CONTEST.

 

XVIII. Changes to Terms

The Church reserves the right, in its sole and absolute discretion, to change the Terms under which the Site is offered. The most current version of the Terms will supersede all previous versions. The Church encourages you to periodically review the Terms to stay informed of our updates.
